Uchendu Mark – Port Harcourt

A High Court sitting in Port Harcourt has restrained the Economic and Financial Crime Commission EFCC, from inviting or threatening arrest of Vice Chancellor of Pamo University of Medical Sciences, Professor Michael Diejomaoh.

Justice George Omereji who gave the judgment, ruled that the invitation letter served on the applicant, Professor Diejomaoh by the EFCC without an explicit reasons of any crime committed constitute a threat to his fundamental human right.

The court held that the prosecution proved his case beyond reasonable doubt, since EFCC could not substantially explain why they want to arrest or detain Professor Micheal Diejomaoh.

The Justice Omereji awarded the sum of seven hundred thousand naira in favour of the applicant as damage cost.

Golden Tamuno who is Counsel to Professor Diejomaoh, explained why the judgment went in the favour of his client.

“The defendant was not able to prove their case, they could not tell the court why they invited my client, even why they were threatening him, so court after looking at our defense, ruled against them”.

Recall that EFCC had sometime in early this year sent an invitation letter to Professor Michael Diejomaoh in his Lagos office, threatening to arrest him.

Professor Diejomoah on 6th May, 2020, filed a fundamental right suit, praying the court to restrain EFFC for infringing on his right from series of threat of arrest.
