A state high court in Port Harcourt has struck out a fundamental human rights and murder chargers against the inspector general of police, commissioner of police and former commander of anti – robbery squad, Akin Fakorode.
Ronke Gberegbe who is the wife of late Chieftain of the the Peoples Democratic Party in Khana, Ferry Gberegbe approached the court to enforce fundamental human rights against the defendants.
She demanded for N800million as compensation from the defendants for the murder of her husband who was allegedly murdered during the late general election in Rivers state.

Our correspondent reports that the trial judge, Justice Adolphus Enebeli, who delivered the judgment, struck out the matter for lacking in merit.
Justice Enebeli based the judgment on the mood of application of the fundamental human rights suit which he said ought to have come in form of writ of summon.
Such format would have given room for witnesses and oral evidence and not originating summon and, thereby struck out of suit.
Speaking to newsmen outside the court, counsel to the applicant, Lizena Amegua said they will not appeal the judgment but will file a fresh charge against the defendants for the interest of justice.

You will recall that there was a video circulated on social media showing the husband of the plaintiff, Dr Ferry Gberegbe fallen down after sporadic shooting during governorship election in Rivers state and died after one week in hospital.
But some stakeholders in the area have also argued that the late Gberegbe did not die of gun shot but poison.
